Review Granted in People v. Archuleta
The California Supreme Court has granted review of People v. Archuleta (S199979) and has deferred briefing pending the Court's decision in several other cases which present issues concerning the right of confrontation under the Sixth Amendment when the results of forensic tests performed by a criminalist who does not testify at trial are admitted into evidence. Archuleta had offered "guidelines" to trial courts as to what factors to consider when an objection is made under Evidence Code §352 to the use of hearsay evidence by a testifying expert.
